1.1 We are committed to safeguarding the privacy of all the individuals with whom we work. This policy applies to: (a) the personnel of our clients and prospective clients; (b) our candidates and prospective candidates; and (c) our website visitors. 1.2 This policy applies where we are acting as a data controller with respect to the personal data of such persons; in other words, where we determine the purposes and means of the processing of that personal data. 1.3 In this policy, "we", "us" and "our" refer to AKP Resources Limited.   1. The personal data that we collect
2.1 In this Section 2 we have set out the general categories of personal data that we process and, in the case of personal data that we did not obtain directly from you, information about the sources and specific categories of that data. 2.2 We may process personal information relating to the personnel of our prospective clients ("prospective client data"). The prospective client data may include your name, job title, email address, telephone number and/or postal address, as well as information in communications passing between us and the prospective client and other business-related information. The sources of the prospective client data are you and/or your employer. We may also collect prospective client data through research using publicly available sources. If a prospective client becomes a client of ours, then at that point the prospective client data will become client data for the purposes of this policy. 2.3 We may process personal information relating to the personnel of our clients ("client data"). The client data may include your name, job title, email address, telephone number and/or postal address, as well as information in communications passing between us and the client and other business-related information. The sources of the client data are you and/or your employer. We may also collect client data through research using publicly available sources. 2.4 We may process personal information relating to our prospective candidates ("prospective candidate data"). The prospective candidate data may include your name, job title, role details, email address, telephone number and/or postal address, as well as information in communications passing between us and you and information contained in your CV. The sources of the prospective candidate data are you, your employer and/or publicly available sources. If a prospective candidate asks us to provide their details to a client of ours, then at that point the prospective candidate data will become candidate data for the purposes of this policy. 2.5 We may process personal information relating to our candidates ("candidate data"). The candidate data may include your name, job title, role details, salary and compensation information, job preferences, educational details, work experience, interests, email address, telephone number and/or postal address, as well as information in communications passing between us, information contained in your CV and other job-related information. The sources of the candidate data are you and/or publicly available sources. 2.6 We may process data about your use of our website and services ("usage data"). The usage data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use. The source of the usage data is our analytics tracking system. 2.7 The "publicly available sources" referred to in this Section 2 include client and candidate websites, the websites of candidate employers and LinkedIn.
  1. Purposes of processing and legal bases
3.1 In this Section 3, we have set out the purposes for which we may process personal data and the legal bases of the processing. 3.2 Operations - We may process your personal data for the purposes of: (a) providing our services, including considering candidates for clients and considering roles for candidates, and placing candidates with clients; (b) negotiating, entering into and managing client contracts; (c) generating invoices, bills and other payment-related documentation, and credit control. In general, the legal basis for this processing is our legitimate interests, namely the proper administration of our services and business; however, the legal basis for the processing of candidate data (including the disclosure of candidate data to clients) will be consent. 3.3 Relationships and communications - We may process prospective client data, client data, prospective candidate data and candidate data for the purposes of managing our relationships, communicating with you and with our clients and candidates (excluding communicating for the purposes of direct marketing) by email, SMS, post and/or telephone, and complaint handling. The legal basis for this processing is our legitimate interests, namely communications with our actual and prospective clients and candidates and the proper administration of our website, services and business. We may also record telephone calls and other voice communications, and the legal basis for the creation of such recordings and processing of data in relation to such recordings will be consent. 3.4 Record keeping - We may process your personal data for the purposes of creating and maintaining our databases, back-up copies of our databases and our business records generally. The legal basis for this processing is our legitimate interests, namely ensuring that we have access to all the information we need properly and efficiently to run our business in accordance with this policy. 3.5 Security - We may process your personal data for the purposes of security and the prevention of fraud and other criminal activity. The legal basis of this processing is our legitimate interests, namely the protection of our website, services and business, and the protection of others. 3.6 Insurance and risk management - We may process your personal data where necessary for the purposes of obtaining or maintaining insurance coverage, managing risks and/or obtaining professional advice. The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks. 3.7 Legal claims - We may process your personal data where necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others. 3.8 Legal compliance and vital interests - We may also process your personal data where such processing is necessary for compliance with a legal obligation to which we are subject or in order to protect your vital interests or the vital interests of another natural person.
  1. Providing your personal data to others
4.1 ‌We may disclose client data to relevant candidates for the purpose of enabling the candidate to contact the client or to consider an available role or opportunity, but we will only make such disclosures with the agreement of the client in question. 4.2 ‌We may disclose candidate data to specific clients for the purpose of enabling the client to consider the candidate for an available role or opportunity, but we will only make such disclosures with the specific and express consent of the candidate in question. Our standard client contract includes a confidentiality clause limiting clients' use of candidate data. Note, however, that in relation to such disclosures the client in question will be an independent controller of the disclosed candidate data, and the client shall be responsible for its own compliance with applicable law with respect to that data. 4.3 We may disclose your personal data to (or store your personal data on the computer systems of) our communications, hosting, accountancy and digital contract services providers insofar as reasonably necessary for the purposes set out in this policy. If you would like us to send you a list of our current services providers, please do get in touch. 4.4 We may disclose your personal data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice. 4.5 In addition to the specific disclosures of personal data set out in this Section 4, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise, or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
  1. International transfers of your personal data
5.1 In the course of the provision of our services, we may transfer your personal data ‌from within the UK to a jurisdiction outside the UK, and/or from within the EEA to a jurisdiction outside the EEA. We will ensure that all such transfers are lawful, whether because of: (a) an adequacy decision of the relevant data protection authority; (b) appropriate safeguards, such as the use of the standard contractual clauses; or (c) individual explicit consent (where the individual has been informed of the possible risks of such transfer due to the absence of an adequacy decision and appropriate safeguards).
  1. Retaining and deleting personal data
6.1 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. 6.2 Accordingly, we will retain your personal data as follows: (a) prospective client data and prospective candidate data will be retained for a maximum period of 12 months following the later of: (i) the date of collection of the relevant data; and (ii) the data of the last communication between us and the relevant prospective client or prospective candidate; (b) candidate data will be retained for a minimum period of 6 years following the most recent placing of the candidate with a client or referral of the candidate to a client, and for a maximum of 7 years following that date; (c) client data will be retained for a minimum period of 6 years following the date of termination of the relevant client contract and for a maximum period of 7 years following that date; and (d) usage data will be retained for 36 months following the date of collection. 6.3 Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
